1. Introduction

These Terms of Service ("Terms") govern your access to and use of the website located at hardmoneyloansofmiami.com and any related services (collectively, the "Service"), operated by Lead Skills, LLC ("we," "us," or "our"). By accessing or using the Service, or by submitting an inquiry, you agree to be bound by these Terms. If you do not agree to these Terms, do not use the Service.

2. Our Role: Lead Generation Service

The Service is a lead-generation platform that connects borrowers with participating hard money lenders who may be able to provide financing. We do not make loans, extend credit, take loan applications, issue loan commitments, set rates or terms, or make any credit decisions. All credit decisions, including loan approval, rates, terms, and funding timelines, are the responsibility of the participating lender. Submitting your information through the Service does not guarantee that you will be matched with a lender or receive a loan offer. All loan programs are subject to borrower and property qualification by the participating lender.

3. No Offer or Solicitation

Content on the Service is provided for informational purposes only and does not constitute an offer to lend, a commitment to lend, or a solicitation for a loan. Rates, loan amounts, terms, and program availability referenced on the Service are illustrative only, vary by participating lender, and are subject to change without notice. Nothing on the Service should be construed as legal, tax, accounting, or investment advice.

4. Eligibility

To use the Service, you must:

• Be at least 18 years old and able to form a legally binding contract.
• Provide true, accurate, current, and complete information when submitting an inquiry.
• Use the Service only for lawful purposes and in accordance with these Terms.

5. Your Consent to Be Contacted

By submitting an inquiry and checking the consent box on our contact form, you provide your prior express written consent for one or more participating lenders to contact you at the phone number and email address you provided, including by autodialer, prerecorded or artificial voice, SMS/text message, and email, regarding your financing inquiry. You understand that your information will be shared with one or more participating lenders who may contact you. Consent is not a condition of receiving any services or obtaining a loan. Message and data rates may apply. Message frequency varies. You may opt out at any time by replying STOP to any text, clicking unsubscribe in any email, or calling 305-363-7986. A current list of participating lenders is available upon request.

6. Equal Opportunity

Hard Money Loans of Miami connects borrowers with lenders who are Equal Opportunity Lenders. Participating lenders do not discriminate on the basis of race, color, religion, national origin, sex, familial status, disability, marital status, or age.

7. Acceptable Use

You agree not to use the Service to:

• Submit false, misleading, or fraudulent information.
• Submit an inquiry on behalf of another person without that person's authorization.
• Violate any applicable federal, state, or local law or regulation.
• Interfere with or disrupt the Service, its servers, or its networks.
• Attempt to gain unauthorized access to any portion of the Service or to other accounts or systems.
• Use any automated means to scrape, harvest, or copy content from the Service.

8. Intellectual Property

The Service and its original content, features, functionality, trademarks, logos, and trade dress are owned by Lead Skills, LLC or its licensors and are protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, sell, or lease any part of the Service or its content without our prior written permission.

9. Third-Party Links and Services

The Service may contain links to third-party websites, including participating lenders, or integrations with third-party services. We do not control and are not responsible for the content, privacy practices, or availability of third-party sites or services. Your interactions with a participating lender or other third party are solely between you and that third party, and any terms or privacy policies of the third party will apply to those interactions.

10. Disclaimers

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS, OR THAT ANY DEFECTS WILL BE CORRECTED. WE MAKE NO WARRANTY THAT YOU WILL BE MATCHED WITH ANY PARTICULAR LENDER OR THAT ANY PARTICIPATING LENDER WILL APPROVE YOUR FINANCING REQUEST OR OFFER ANY PARTICULAR RATES OR TERMS.

11. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, LEAD SKILLS, LLC AND ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AND LICENSORS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, GOODWILL, OR BUSINESS OPPORTUNITIES, ARISING OUT OF OR RELATING TO YOUR USE OF THE SERVICE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THE SERVICE WILL NOT EXCEED ONE HUNDRED U.S. DOLLARS ($100).

12. Indemnification

You agree to indemnify, defend, and hold harmless Lead Skills, LLC and its affiliates, officers, directors, employees, agents, and licensors from and against any claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or relating to your use of the Service, your violation of these Terms, your violation of any law or the rights of a third party, or any information you submit through the Service.

13. Governing Law

These Terms are governed by the laws of the State of Florida, without regard to its conflict-of-laws principles. Any dispute arising out of or relating to these Terms or the Service will be brought exclusively in the state or federal courts located in Miami-Dade County, Florida, and you consent to the personal jurisdiction and venue of those courts.

14. Changes to These Terms

We may update these Terms from time to time. When we make material changes, we will update the "Last Updated" date above and, where appropriate, provide additional notice. Your continued use of the Service after changes take effect constitutes acceptance of the updated Terms.
